The type of personal information I collect
I collect and process the following information:
· Personal identifiers: your name, phone number, email address (You provide these to me when you first contact me via Psychology Today/Counselling Directory/ or Directly via my website)
· I will ask you to fill in a form containing personal information, this includes the above (Name, number etc) as well as your address, next of kin details, GP details and medical history. I will hold a copy of this.
· I hold a signed copy of your counselling contract
· I hold a signed copy of this privacy notice
· I will hold brief records of our sessions, which may contain sensitive personal data
How I get the personal information and why I have it
Most of the personal information we process is provided to me directly by you for one of the following reasons:
· So that I can get to know you and to carry out an initial assessment, before you begin counselling therapy. I also receive personal information indirectly, from the following sources in the following scenarios:
· If you discuss information such as your sexuality, your religious background during sessions this may be added into my brief notes of our session. (Please see special category data)
Special Category Data
Under Article 9 of GDPR I meet conditions to process special category data; condition A) explicit consent (as you are discussing information which falls under special category data) willingly in therapy sessions.
This includes information about your sexual orientation, racial or ethnic origin, political opinion or any health information.
I will not share any of your personal information with any organisations or people, EXCEPT in the following situations:
SERIOUS HARM- If you share information with me, that makes me believe you are at risk from yourself or others, or that you pose a risk to others, I may have to breach our confidentiality policy to ensure your safety. I will always tell you before I do this.
I may share this information with Police or Social Services. I will only disclose the reasons for concern, not the details of our sessions.
CONSENT- If you ask me to contact a professional such as a GP, or anyone else, I will do so with your permission.
COMPLIANCE WITH THE LAW- If my notes are subpoenaed by a court of law, I will have to provide these.
Supervision- as you are aware from the counselling agreement, I discuss our sessions with my supervisor, however your personal identifiable information is not disclosed, my supervisor would not be able to identify you, as only the reasons for attending therapy are discussed.
Under the General Data Protection Regulation (GDPR), the lawful bases we rely on for processing this information are:

I have a legitimate interest- I process your data to provide you with counselling.
I use the following information that you have given me in order to:
Name, date of birth- Basic information to help me get to know you
Email/Telephone number- To get in contact with you to arrange counselling sessions
Address: This is kept in case you were ever at risk, and I needed to request a Police welfare check
Next of Kin- In case you suddenly became unwell and I would need to notify someone
GP Details- In case I felt you were at risk and I needed to contact your GP. I will always discuss this with you beforehand, unless I feel you are at risk to yourself or to others.
Medication/Medical conditions- I use this information to help me inform my counselling practice with you, and to understand any impact or side effects from medication, as this may be discussed in our therapy sessions.
Session Notes- This is a standard professional procedure; I am required to keep brief notes of what we discussed in our session.
How I store your personal information
Your information is securely stored in lockable filing cabinets at my home. Your personal information form is stored in a locked filing cabinet, which will be kept separate from your session notes.
The session notes that I keep are kept separate from your personal data. Your session notes are anonymised with a unique code, which I know corresponds to your personal information.
I keep your personal details and sessions notes for 5 years as requested by my insurance company. I will then dispose of your information by shredding your personal information forms, and session notes.
Your data protection rights
Under data protection law, you have rights under the lawful basis of which I process your data.
Under consent you have:
Your right to erasure - You have the right to ask me to erase your personal information in certain circumstances.
Your right of access - You have the right to ask me for copies of your personal information.
Your right to data portability - You have the right to ask that I transfer the personal information you gave me to another organisation, or to you, in certain circumstances. However, this will not apply for legitimate interests, it is not a legitimate interest for me to transfer your information on to another organisation.
You can withdraw your consent to me processing your information.
Under Legitimate interests you have the right to:
Your right to erasure - You have the right to ask me to erase your personal information in certain circumstances.
Your right to object to processing - You have the the right to object to the processing of your personal information in certain circumstances.
You are not required to pay any charge for exercising your rights. If you make a request, I have one month to respond to you.
